bus shelters?

Does this make sense? a question about smoking in bus shelters


1. How many bus shelters are there within the Brighton and Hove council area (owned or not)?
2. How many of these have no smoking signs attached to them?
3.. How many of those are considered to be either "Enclosed" or "Substantially Enclosed" within the terms of the English smoking ban law?
4. How many of those that are NOT either enclosed or substantially enclosed are displaying signage stating that smoking is against the law? Locations would be helpful.
5. How many prosecutions have been made for smoking within a bus shelter? I would prefer locations split between enclosed, substantially enclosed and open shelters if available."


Please find set out below the information in response to the above
request:

"The bus shelters in Brighton and Hove are owned and maintained by the
private advertising company Clearchannel, and they are responsible for
ensuring that they comply with all current legislation. It is their
decision as to how they interpret the law and I believe they display no
smoking signs within all the shelters as they perceive them to be either
substantially or totally enclosed according to the legal definition.

At the last count I believe there are 426 shelters within the city. I
believe they all carry 'No Smoking' signs which are routinely replaced
by their operatives, as necessary.

As far as I am aware there have not been any prosecutions under the
legislation but there is no way that I would know one way or the other.
It is obvious that legislation around smoking in shelters is very hard
to enforce.

I have received no public complaints in relation to the legislation and
how it applies to shelters.
